***** EVENT ATTENDEE WAIVER AND RELEASE OF LIABILITY FORM ******** The following is a disclaimer between you and Green Dragon. Please read the disclaimer carefully.

Green Dragon continues to monitor marijuana law and policy and procedures. The safety and well-being of our community, including club members, guests and visitors, is our top priority. We are following federal, state, and local laws to implement best practices aimed at providing a safe atmosphere for our social club.

Green Dragon continues to monitor policy and procedures during the COVID-19 pandemic so we can implement best practices aimed at managing the spread of the novel and complex virus. Green Dragon has put in place preventative measures to reduce the spread of the COVID-19 virus; however, under no circumstances, are we able to guarantee that you or a guest will not become infected with the virus while attending one of our events or being in surrounding areas. Adherence to Green Dragon event policy and guidelines will be continuously monitored and enforced by Green Dragon personnel. Please review agreement below.

Additionally, your signature will be required as a confirmation of your intent and commitment to abide by law and Green Dragon policies put in place to protect social club members, visitors/guests, and staff. Agreement:

● I declare I am not experiencing or exhibiting any COVID-19 related symptoms as outlined by the federal and state Center for Disease Control and Prevention (CDC) such as fever, dry cough, or shortness of breath.

● I acknowledge I must follow the safety protocols that have been implemented by NJIT and posted in buildings on campus property including practicing social distancing and maintaining separation of six feet from individuals.

● I declare I have not traveled internationally or to a highly impacted COVID-19 area within the United State during the last (14) days.

● I am not aware nor do I believe I have been recently exposed to a person or animal with a positive and confirmed case if COVID-19.

● I acknowledge I may be removed from an event or asked to leave campus property by university personnel should I exhibit any behavior in direct contrast to university guidelines and safety measures.

Signature: By signing this event attendee waiver and release of liability form, I acknowledge the contagious and evolving nature of COVID-19 and voluntarily assume the risk that I may be exposed to virus and become affected as a result. I understand the risk of becoming infected may

impact members of the university community, event guests, and event attendee’s families or personal contacts. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any expense, liability, illness, injury, disability or death related to contracting the virus while attending an event hosted at Green Dragon.

I hereby release, covenant not to sue, discharge, and hold harmless Green Dragon from all claims any kind arising out of COVID-19.

I understand and agree that release of liability includes any claims towards Green Dragon, and personnel, representatives whether a COVID-19 infection occurrence exists before, during, or after attendance and participation at an event on Green Dragon property. Event attendees are required to be at least the age of twenty-one (21) years, said event attendee’s legal guardian(s) shall be jointly and severally liable for the event attendee’s performance of this event if applicable.

The attendee waiver and release of liability form, represents and warrants to Green Dragon that they have full authority to enter into this event attendee waiver and release of liability form on their own behalf.

This event attendee waiver and release of liability form shall be governed by and construed under the laws of the State of New Jersey, without regard to its choice of law principals. I agree not to commence or prosecute any action in connection herewith other than in the state and/or federal courts of the State of New Jersey, Essex County.

I agree to be bound by all terms of this event attendee waiver and release of liability form, as indicated by our signatures below.

Additionally, your signature will be required as a confirmation of your intent and commitment to abide by law and Green Dragon policies put in place to protect social club members, visitors/guests, and staff. Agreement:

● I declare I am not involved in illegal drug sales or planning to use Green Dragon Events to perpetuate any illegal drug use or sales in accordance with federal, state, and local laws.

● I acknowledge I must follow the protocols that have been implemented by Green Dragon and posted in buildings on property including following no smoking areas and maintaining lawful behavior throughout the event.

● I declare that in no way has Green Dragon enticed me to attend this event with the promise of illegal behavior or opportunities to participate in any illegal behavior.

● I acknowledge I may be removed from an event or asked to leave the event property by Green Dragon personnel should I exhibit any behavior in direct contrast to state, federal, and local laws or Green Dragon guidelines and safety measures.

Signature:

By signing this event attendee waiver and release of liability form, I acknowledge that I voluntarily assume responsibility for my own actions that may risk my legal status and that I may be prosecuted by the appropriate authorities for any illegal behavior I engage in. I understand the risk of becoming arrested may impact members of the social club, community, event guests, and event attendee’s families or personal contacts.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any expense, liability, injury, disability or death related to breaking the law while attending an event hosted at Green Dragon.

I hereby release, covenant not to sue, discharge, and hold harmless Green Dragon from all claims any kind arising out of my behavior.

I understand and agree that release of liability includes any claims towards Green Dragon, and personnel, representatives whether a occurrence exists before, during, or after attendance and participation at an event on Green Dragon property.

Event attendees are required to be at least the age of twenty-one (21) years, said event attendee’s legal guardian(s) shall be jointly and severally liable for the event attendee’s performance of this event if applicable.

Attending our events may require a membership with Green Dragon. A membership with Green Dragon is valuable, and you are responsible for maintaining its confidentiality and security. Green Dragon is not responsible for any losses arising from the unauthorized use of your information.

You must be age twenty-one (21) to have a membership with Green Dragon.

Your attendance of our events is subject to Green Dragon’s Privacy Policy. Green Dragon Privacy Policy
What Is Personal Data

At Green Dragon, we believe strongly in fundamental privacy rights — and that those fundamental rights should not differ depending on where you live in the world. That’s why we treat any data that relates to an identified or identifiable individual or that is linked or linkable to them by Green Dragon as “personal data,” no matter where the individual lives. This means that data that directly identifies you — such as your name — is personal data, and also data that does not directly identify you, but that can reasonably be used to identify you. Aggregated data is considered non-personal data for the purposes of this Privacy Policy. This Privacy Policy covers how Green Dragon handles personal data whether you interact with us on our websites, through Green Dragon apps, or in person (including by phone or when visiting our retail stores or events). Green Dragon may also link to third parties on our events or make third-party apps available for download in the App Store. Green Dragon’s Privacy Policy does not apply to how third parties define personal data or how they use it. We encourage you to read their privacy policies and know your privacy rights before interacting with them.

Your Privacy Rights at Green Dragon

We respect your ability to know, access, correct, transfer, restrict the processing of, and delete your personal data. We have provided these rights to our global customer base and if you choose to exercise these privacy rights, you have the right not to be treated in a discriminatory way nor to receive a lesser degree of service from Green Dragon. Green Dragon does not sell your data including as “sale” is defined in New Jersey. To exercise your privacy rights and choices including where a third-party service provider is acting on Green Dragon’s behalf.

There may be situations where we cannot grant your request for example, if you ask us to delete your transaction data and Green Dragon is legally obligated to keep a record of that transaction to comply with law. We may also decline to grant a request where doing so would undermine our legitimate status as a company such as when you request deletion of an account that is being investigated by law enforcement. Other reasons your privacy request may be denied are if it jeopardizes the privacy of others, is frivolous or vexatious, or would be extremely impractical.

Government ID Data.

In certain jurisdictions, we may ask for a government-issued ID in limited circumstances for the purpose staying in compliance as required by law

Green Dragon may rely on your consent or the fact that the processing is necessary to protect your vital interests or those of other members, or to comply with law

Power Our Events.

Green Dragon collects personal data necessary to power our events, which may include personal data collected to improve our offerings, for internal purposes such as auditing or data analysis, or for troubleshooting

Communicate with You.

To respond to communications, reach out to you about your account, market our products and events, provide other relevant information, or request information or feedback. From time to time, we may use your personal data to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with Green Dragon, you may not opt out of receiving these important notices.

Security and Fraud Prevention.

To protect members, employees, and Green Dragon and for loss prevention, including to protect individuals, employees, and Green Dragon for the benefit of all our users, and prescreening or scanning uploaded content for potentially illegal content.

Personal Data Used for Personalization.

If you choose to personalize your services or communications where such options are available, Green Dragon will use information that we collect so that we can offer you those personalized services or communications.

Comply with Law.

To comply with applicable law — for example, to satisfy tax or reporting obligations, or to comply with a lawful governmental request. Green Dragon does not use algorithms or profiling to make any decision that would significantly affect you without the opportunity for human review. Green Dragon retains personal data only for so long as necessary to fulfill the purposes for which it was collected, including as described in this Privacy Policy or in our service-specific privacy notices, or as required by law. We will retain your personal data for the period necessary to fulfill the purposes outlined in this Privacy Policy and our service-specific privacy summaries. When assessing retention periods, we first carefully examine whether it is necessary to retain the personal data collected and, if retention is required, work to retain the personal data for the shortest possible period permissible under law. Green Dragon’s Sharing of Personal Data may share personal data with Green Dragon-affiliated companies, service providers who act on our behalf, our partners, developers, and publishers, or others at your direction. Further, Green Dragon does not share personal data with third parties for their own marketing purposes.

Service Providers.

Green Dragon may engage third parties to act as our service providers and perform certain tasks on our behalf, such as processing or storing data, including personal data, in connection with your use of our services and delivering products to customers. Green Dragon service providers are obligated to handle personal data consistent with this Privacy Policy and according to our instructions. They cannot use the personal data we share for their own purposes and must delete or return the personal data once they’ve fulfilled our request.

Partners.

At times, Green Dragon may partner with third parties to provide events or other offerings. For example, Green Dragon financial offerings. Green Dragon requires its partners to protect your personal data.

Audio and Video Captures at events:
It is not allowed to post any social media indicating the location of the event.

It is not allowed to post or take any pictures of any employee, personnel, or members of Green Dragon without explicit written informed consent of Green Dragon and any person in the photo, video, or audio content.

YOUR SUBMISSIONS TO OUR EVENTS

Our Events may allow you to submit or post materials such as comments, ratings and reviews, pictures, videos, and podcasts (including associated metadata and artwork). Your use of such features must comply with the Submissions Guidelines below, which may be updated from time to time, and if we become aware of materials that violate our Submission Guidelines we will remove them. If you see materials that do not comply with the Submissions Guidelines, please use the Report a Concern feature. Except to the extent prohibited by law, you hereby grant Green Dragon a worldwide, royalty-free, perpetual, nonexclusive license to use the materials you submit and related marketing as well as to use the materials you submit for Green Dragon internal purposes. Green Dragon may monitor and decide to remove or edit any submitted material.

Submissions Guidelines: You may not use the Event to:

– post any materials that (i) you do not have permission, right or license to use, or (ii) infringe on the rights of any third party;

– post objectionable, offensive, unlawful, deceptive, inaccurate, or harmful content;

– post personal, private or confidential information belonging to others;

– impersonate or misrepresent your affiliation with another person, or entity;

– post or transmit spam, including but not limited to unsolicited or unauthorized advertising, promotional materials, or informational announcements;

– post, modify, or remove a rating or review in exchange for any kind of compensation or incentive;

– post a dishonest, abusive, harmful, misleading, or bad-faith rating or review, or a rating or review that is irrelevant to the Content being reviewed;

– plan or engage in any illegal, fraudulent, or manipulative activity.

NO WARRANTY: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE ATTENDANCE OF OUR EVENTS IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE EVENT AND ANY SERVICES PERFORMED OR PROVIDED BY GREEN DRAGON ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND GREEN DRAGON HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE EVENT AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY GREEN DRAGON OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL GREEN DRAGON BE LIABLE FOR ANY CRIME, PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, CORRUPTION OR LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF ATTENDANCE TO EVENT OR RELATED TO YOUR ATTENDANCE OF THE EVENT, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF GREEN DRAGON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CRIMINAL BEHAVIOR, PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.

In no event shall Green Dragon’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of two hundred and fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

CONTRACT CHANGES

Green Dragon reserves the right at any time to modify this Agreement and to add new or additional terms or conditions on your use of the Services. Such modifications and additional terms and conditions will be effective immediately and incorporated into this agreement. Your continued use of the Services will be deemed acceptance thereof.

THIRD-PARTY MATERIALS

Green Dragon is not responsible or liable for third party materials included within or linked from the event or the Services.

Green Dragon has adopted a policy to disable and/or terminate in appropriate circumstances the accounts of users who are found repeatedly to infringe or are repeatedly claimed to infringe the copyrights of others. As part of implementing such policy, Green Dragon may in its sole discretion suspend, disable and/or terminate the accounts of users who have been identified as repeatedly engaging in infringing activities or for other related reasons.

If you fail, or Green Dragon suspects that you have failed, to comply with any of the provisions of this Agreement, Green Dragon may, without notice to you: (i) terminate this Agreement and/or your Green Dragon Membership, and you will remain liable for all amounts due under your Green Dragon Membership up to and including the date of termination.

Green Dragon further reserves the right to modify, suspend, or discontinue the Membership (or any part or Content thereof) at any time with or without notice to you, and Green Dragon will not be liable to you or to any third party should it exercise such rights.

GREEN DRAGON DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR ATTENDANCE OF THE EVENT WILL BE UNINTERRUPTED OR ERROR-FREE, AND YOU AGREE THAT FROM TIME TO TIME GREEN DRAGON MAY REMOVE THE EVENTS FOR INDEFINITE PERIODS OF TIME, CANCEL THE EVENTS AT ANY TIME, OR OTHERWISE LIMIT OR DISABLE YOUR ACCESS TO THE EVENTS WITHOUT NOTICE TO YOU.

YOU EXPRESSLY AGREE THAT YOUR USE OF, OR INABILITY TO USE, OR ACTIVITY IN CONNECTION WITH THE EVENTS IS AT YOUR SOLE RISK. THE EVENTS AND ALL CONTENT DELIVERED TO YOU THROUGH THE EVENT ARE (EXCEPT AS EXPRESSLY STATED BY GREEN DRAGON) PROVIDED “AS IS” AND “AS AVAILABLE” FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, THE ABOVE EXCLUSION OF IMPLIED WARRANTIES MAY NOT APPLY TO YOU.

IN NO CASE SHALL GREEN DRAGON, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR MEMBERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF ANY OF THE EVENT OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE EVENT AND/OR CONTENT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY INJURY, LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE EVENT, EVEN IF ADVISED OF THEIR POSSIBILITY. BECAUSE SOME COUNTRIES, STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF

LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH COUNTRIES, STATES OR JURISDICTIONS, GREEN DRAGON’S LIABILITY SHALL BE LIMITED TO THE EXTENT SUCH LIMITATION IS PERMITTED BY LAW.

GREEN DRAGON SHALL USE REASONABLE EFFORTS TO PROTECT INFORMATION SUBMITTED BY YOU IN CONNECTION WITH THE EVENTS, BUT YOU AGREE THAT YOUR SUBMISSION OF SUCH INFORMATION IS AT YOUR SOLE RISK, AND YOU HEREBY RELEASE GREEN DRAGON FROM ANY AND ALL LIABILITY TO YOU FOR ANY LOSS OR LIABILITY RELATING TO SUCH INFORMATION IN ANY WAY.

GREEN DRAGON DOES NOT REPRESENT OR GUARANTEE THAT THE EVENT WILL BE FREE FROM LOSS, CORRUPTION, ATTACK, VIRUSES, INTERFERENCE, HACKING, OR OTHER SECURITY INTRUSION, AND YOU HEREBY RELEASE GREEN DRAGON FROM ANY LIABILITY RELATING THERETO. YOU SHALL BE RESPONSIBLE FOR YOUR OWN ACTIONS.

BY ATTENDING THE EVENT, YOU AGREE, TO THE EXTENT PERMITTED BY LAW, TO INDEMNIFY AND HOLD GREEN DRAGON, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND INNOCENT MEMBERS HARMLESS WITH RESPECT TO ANY CLAIMS ARISING OUT OF YOUR BREACH OF THIS AGREEMENT, YOUR USE OF THE SERVICES, OR ANY ACTION TAKEN BY GREEN DRAGON AS PART OF ITS INVESTIGATION OF A SUSPECTED VIOLATION OF THIS AGREEMENT OR AS A RESULT OF ITS FINDING OR DECISION THAT A VIOLATION OF THIS AGREEMENT HAS OCCURRED. YOU AGREE THAT YOU SHALL NOT SUE OR RECOVER ANY DAMAGES FROM GREEN DRAGON, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND AS A RESULT OF ITS DECISION TO REMOVE OR DENY ACCESS TO ANY INFORMATION OR CONTENT, TO SUSPEND OR TERMINATE YOUR ACCESS TO THE EVENTS, OR TO TAKE ANY OTHER ACTION DURING THE INVESTIGATION OF A SUSPECTED VIOLATION OR AS A RESULT OF GREEN DRAGON’S CONCLUSION THAT A VIOLATION OF THIS AGREEMENT HAS OCCURRED. THIS WAIVER AND INDEMNITY PROVISION APPLIES TO ALL VIOLATIONS DESCRIBED IN OR CONTEMPLATED BY THIS AGREEMENT.

Except to the extent expressly provided in the following paragraph or to the extent required by applicable law, this Agreement and the relationship between you and Green Dragon, and all transactions on the events shall be governed by the laws of the State of NEW JERSEY, excluding its conflicts of law provisions. You and Green Dragon agree to submit to the personal and exclusive jurisdiction of the courts located within the STATE OF NEW JERSEY, to resolve any dispute or claim arising from this Agreement.

between you and Green Dragon. You also may be subject to additional terms and conditions that may apply when you make transactions or use affiliate services, third-party content. If any part of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. Green Dragon ‘s failure to enforce any right or provisions in this Agreement will not constitute a waiver of such or any other provision. Green Dragon will not be responsible for failures to fulfill any obligations due to causes beyond its control.

You agree to comply with all local, state, federal, and national laws, statutes, ordinances, and regulations that apply to your attendance of the event. Your attendance of the event may also be subject to other laws. No Green Dragon employee or agent has the authority to vary this Agreement.

Green Dragon may notify you with respect to the event. Notices shall become effective immediately.

You hereby grant Green Dragon the right to take steps Green Dragon believes are reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement. You agree that Green Dragon has the right, without liability to you, to disclose any data and/or information to law enforcement authorities, government officials, and/or a third party, as Green Dragon believes is reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement (including but not limited to Green Dragon ‘s right to cooperate with any legal process relating to your use of the EVENT and/or Content, and/or a third-party claim that your use of the EVENT and/or Content is unlawful and/or infringes such third party’s rights).
